1. ABOUT US
Welcome to 3D&Co.
These Terms and Conditions (βTermsβ) apply when you access our website, purchase from us, place a custom order, or otherwise use our products or services.
In these Terms, β3D&Coβ, βweβ, βusβ and βourβ refer to 3D&Co.
By placing an order with us, you agree to these Terms together with any other policies displayed on our website.
Our online store is powered by Shopify.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under applicable Australian law.
2. OUR PRODUCTS
3D&Co specialises in 3D-printed, personalised and made-to-order products.
Due to the nature of 3D printing and handmade production, minor variations may occur between products.
These may include slight variations in:

colour;
-
texture;
-
visible layer lines;
-
surface finish;
-
dimensions;
-
positioning of personalised elements;
-
placement or appearance of photographs or graphics; and
-
other minor characteristics associated with the 3D-printing process.
Minor variations that are inherent to 3D printing or handmade production are not considered faults.
We make every reasonable effort to accurately represent our products through photographs, mock-ups and descriptions.
However, colours and appearance may vary depending on your device, screen settings, lighting and the materials used during production.
3. PERSONALISED AND CUSTOM ORDERS
Many 3D&Co products are created specifically for each customer.
Customers are responsible for carefully checking all information supplied before placing or approving an order, including:

names;
-
spelling;
-
dates;
-
wording;
-
photographs;
-
images;
-
colours;
-
dimensions;
-
design selections; and
-
any other personalisation details.
We will create personalised products based on the information provided by the customer.
Where we provide a digital proof, mock-up or design preview, production may not commence until approval has been received.
Once a proof has been approved or production has commenced, changes may not be possible.
If a customer requests a change after production has commenced, additional production or material costs may apply.
We reserve the right to refuse customisation requests that we reasonably consider unlawful, offensive, discriminatory, defamatory, inappropriate or potentially infringing another person's intellectual property rights.
4. RETURNS, REFUNDS AND EXCHANGES FOR CUSTOM PRODUCTS
All personalised, customised and made-to-order products are created specifically for each customer.
For this reason, 3D&Co does not accept returns, exchanges or provide refunds for change of mind on personalised, customised or made-to-order products.
A return, exchange or refund will not be provided where:
-
the customer changes their mind;
-
incorrect information was supplied or approved by the customer;
-
the customer selected the incorrect colour, design, size or personalisation;
-
the customer supplied a poor-quality or unsuitable photograph or image and the finished product reasonably reflects the supplied image;
-
the customer no longer requires the product;
-
the customer finds a similar product elsewhere;
-
the customer is dissatisfied with a design, colour, image or personalisation that they previously approved; or
-
minor variations occur as part of the normal 3D-printing or handmade production process.
Nothing in this section excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian law.
5. CUSTOMER-SUPPLIED PHOTOGRAPHS, IMAGES AND DESIGNS
Where you provide us with photographs, graphics, logos, artwork, text or other material for use in a personalised product, you confirm that:
-
you own the material or have permission to use it;
-
you have permission to reproduce any relevant person's image where required;
-
our use of the material to fulfil your order will not infringe another person's copyright, trademark, privacy or other rights; and
-
the material is not unlawful or otherwise prohibited.
You give 3D&Co permission to reproduce, resize, crop, convert, edit or otherwise process the supplied material as reasonably necessary to create your order.
This permission is limited to fulfilling your order and providing associated customer service unless separate permission has been given for another use.
We reserve the right to refuse to reproduce material that we reasonably believe may infringe another person's intellectual property rights.
6. IMAGE QUALITY
The quality of personalised photo products depends heavily on the quality of the image supplied by the customer.
For best results, customers should provide clear and high-resolution photographs.
Images that are:
-
blurry;
-
pixelated;
-
very dark;
-
overexposed;
-
heavily compressed;
-
screenshots; or
-
otherwise low quality
may result in a lower-quality finished product.
Where reasonably possible, we may contact you if we believe an image is unsuitable.
However, customers remain responsible for the quality and suitability of the files supplied to us.
A poor reproduction resulting directly from the quality of the original customer-supplied image will not generally be considered a manufacturing defect where the finished product reasonably reflects the supplied image.
7. DESIGN MOCK-UPS AND APPROVAL
Where a proof, mock-up or preview is provided, it is intended to give a reasonable representation of the proposed finished product.
Customers are responsible for checking the proof carefully before approving it.
Approval confirms acceptance of matters including:

spelling;
-
layout;
-
wording;
-
image selection;
-
image orientation;
-
colour selections; and
-
personalisation details.
Once a design has been approved and production has commenced, changes may not be possible.
Minor differences may occur between an on-screen preview and the finished physical product due to screen displays, 3D-printing processes, materials and lighting.
8. ORDERS
Placing an order constitutes an offer to purchase from 3D&Co.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
-
a product or material is unavailable;
-
there has been an obvious pricing or product-description error;
-
we cannot reasonably fulfil the requested customisation;
-
an order appears fraudulent;
-
the requested design may infringe intellectual property rights;
-
payment cannot be processed; or
-
circumstances outside our reasonable control prevent us from completing the order.
Orders are not considered accepted until payment has been successfully processed and the order has been confirmed.
9. CANCELLATIONS AND CHANGES
Personalised and made-to-order products may enter production shortly after an order is placed.
Once production has commenced, cancellations or changes may not be possible.
Customers should therefore check all order details carefully before submitting their order.
Where we agree to make changes after production has commenced, additional costs may apply to cover additional materials, printing time or design work.
10. 3D-PRINTED PRODUCT CARE
3D-printed products may be affected by heat, moisture, pressure and prolonged exposure to sunlight depending upon the material used.
Unless a product is specifically described as suitable for those purposes, customers should avoid:

exposing products to excessive heat;
-
placing products in a dishwasher;
-
exposing products to prolonged direct sunlight;
-
placing products near open flames;
-
placing products near heating appliances;
-
leaving products inside hot vehicles;
-
applying excessive pressure or weight; and
-
using decorative products for purposes for which they were not designed.
Any care instructions supplied with a product should be followed.
Damage caused by misuse, accidental damage, inappropriate storage or failure to follow reasonable care instructions will not generally be considered a manufacturing defect.
11. DECORATIVE ITEMS AND CHILD SAFETY
Unless expressly stated otherwise, decorative 3D-printed items are not toys.
Some products may contain:
-
small components;
-
detachable pieces;
-
magnets;
-
cords;
-
pointed decorative elements; or
-
other components unsuitable for babies or young children.
Decorative items should be kept away from babies and young children where appropriate.
Parents and carers are responsible for ensuring products are used and displayed appropriately.
Products specifically advertised as suitable for children should be used according to any instructions supplied with the product.
12. FOOD AND DRINK USE
Unless a product is specifically described by 3D&Co as suitable for food contact, food use or beverage use, 3D-printed products should not be assumed to be food safe.
Products should not be used to hold hot food or beverages unless specifically stated by 3D&Co as suitable for that purpose.
13. PRICES AND PAYMENT
All prices are displayed in Australian dollars unless otherwise stated.
Shipping charges and any additional costs will be displayed before checkout or otherwise communicated before an order is confirmed.
Prices may change from time to time.
Any pricing changes will generally not affect an order that has already been accepted, except where there has been an obvious pricing error.
Payment must be made using one of the payment methods available through our website or otherwise agreed with 3D&Co.
14. PRODUCTION TIMES
Many 3D&Co products are made to order.
Any production times displayed on our website or communicated to customers are estimates unless we have specifically agreed otherwise.
Production times may vary depending on:

order volume;
-
complexity of the product;
-
customisation requirements;
-
material availability;
-
equipment availability;
-
failed prints requiring reprinting;
-
design changes; and
-
seasonal demand.
Where we become aware of a significant production delay, we will make reasonable efforts to notify affected customers.
15. SHIPPING AND DELIVERY
Delivery timeframes are estimates unless specifically stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including:
-
carrier delays;
-
weather;
-
peak delivery periods;
-
transport disruptions; and
-
other logistical issues.
Customers are responsible for providing a complete and accurate delivery address.
Where additional shipping costs arise because incorrect delivery information was supplied by the customer, the customer may be responsible for those additional costs where permitted by law.
16. COLLECTION ORDERS
Where local collection is available, customers will be notified when their order is ready.
Customers should not attend for collection until confirmation has been received that the order is ready.
Any collection instructions provided by 3D&Co must be followed.
17. INTELLECTUAL PROPERTY
Unless otherwise stated, content created by 3D&Co for our business remains the intellectual property of 3D&Co or the relevant rights holder.
This includes our:

logo;
-
branding;
-
original photographs;
-
original product designs;
-
website content;
-
graphics;
-
marketing materials; and
-
original digital content.
You may not reproduce, copy, distribute, sell or commercially use our original content without our prior permission.
Third-party characters, logos, trademarks, artwork and other intellectual property remain the property of their respective owners.
Where products contain customer-supplied or third-party material, 3D&Co does not claim ownership of that underlying material.
18. THIRD-PARTY INTELLECTUAL PROPERTY
Requests involving characters, logos, brands, sports teams, artwork or other protected material may be refused where appropriate permission cannot be established.
Acceptance of a custom request does not constitute a representation by 3D&Co that the requested material is free from third-party intellectual property rights.
Customers requesting reproduction of their own business logo, artwork or similar material confirm that they have authority to authorise its reproduction.
19. PRODUCT PHOTOGRAPHY AND SOCIAL MEDIA
We may photograph completed products for portfolio, website or social-media purposes.
Where a product contains identifiable personal photographs, private information or sensitive personalised details, we may seek permission before publishing that content where appropriate.
Customers who do not wish for their personalised product to be photographed or shared publicly may contact us.
20. WEBSITE CONTENT
We make reasonable efforts to ensure information on our website is accurate and current.
Occasionally information may contain errors relating to:
-
product descriptions;
-
prices;
-
availability;
-
photographs;
-
promotions; or
-
delivery information.
We reserve the right to correct errors or update information where reasonably necessary.
21. THIRD-PARTY SERVICES
Our website may use or link to third-party services including:

Shopify;
-
payment providers;
-
delivery providers;
-
social-media platforms; and
-
other technology providers.
Those services may operate under their own terms and privacy policies.
3D&Co is not responsible for the independent operation or content of third-party websites or services to the extent permitted by law.
22. PRIVACY
We may collect personal information that is reasonably required to process and fulfil orders.
This may include:

your name;
-
email address;
-
telephone number;
-
billing and delivery details;
-
payment information;
-
photographs;
-
personalisation information; and
-
other information required to complete your order.
Our store is hosted using Shopify, and personal information may also be processed by Shopify and other service providers used to operate our business and fulfil customer orders.
23. REVIEWS AND CUSTOMER CONTENT
If you provide a review, photograph or other content to 3D&Co, we may request permission to share or repost that content for promotional purposes.
Submitting a review does not automatically transfer ownership of your original photographs or other content to 3D&Co.
24. PRODUCT USE AND LIABILITY
Customers are responsible for using products appropriately and in accordance with any instructions supplied.
To the maximum extent permitted by law, 3D&Co will not be responsible for loss or damage resulting from:

misuse of a product;
-
use of a product for a purpose for which it was not designed;
-
failure to follow product-care instructions;
-
accidental damage;
-
unauthorised modification of a product;
-
exposure to excessive heat or environmental conditions; or
-
circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any liability, right or remedy that cannot lawfully be excluded.
25. PROHIBITED USE
You must not use our website or services:
-
for unlawful purposes;
-
to infringe another person's intellectual property rights;
-
to transmit malicious software;
-
to attempt unauthorised access to our systems;
-
to submit fraudulent orders;
-
to harass or threaten another person;
-
to provide knowingly false or misleading information; or
-
in any way that interferes with the proper operation of our website or services.
We reserve the right to refuse service or cancel an order where reasonably necessary in response to fraudulent, unlawful or abusive conduct.
26. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to additional conditions.
Unless otherwise stated:

discount codes cannot be exchanged for cash;
-
only one discount code may be used per transaction;
-
codes must be used before their stated expiry date;
-
discount codes cannot be applied retrospectively; and
-
particular products or custom orders may be excluded from promotions.
27. EVENTS OUTSIDE OUR CONTROL
3D&Co will not be responsible for delays caused by events outside our reasonable control.
These may include:

natural disasters;
-
extreme weather;
-
transport disruptions;
-
supplier interruptions;
-
power failures;
-
equipment failures;
-
material shortages; or
-
other unforeseen circumstances.
Where such circumstances significantly affect an order, we will make reasonable efforts to communicate with the customer.
28. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia and the applicable laws of the Commonwealth of Australia.
The parties submit to the jurisdiction of the courts and tribunals of New South Wales and Australia as applicable.
29. CHANGES TO THESE TERMS
3D&Co may update these Terms from time to time.
The latest version will be displayed on our website together with the date it was last updated.
The Terms applying to an order will generally be those in effect at the time the order was placed.
